DISCLAIMER: ODOMETER DISCREPANCY Section 4: Buyer and Seller Information – Completed by Buyer and Seller: Section 5: Power of Attorney – Provided for simplicity and can be used whenever a Power of Attorney is required. This section does not need to be completed if it is only used for odometer purposes, but is required if a lawyer actually signs on the title, with the exception of the odometer. The Power of Attorney Form (REG 260) is available online. Next, the seller must define the accuracy of the odometer. To this end, two selections are listed under the opening statement. The vehicle/vessel transfer and reassignment form (REG 262) is used for odometer disclosure if: 6. STANDARD AND ACCELERATION CLAUSE. If the Borrower is in default of payment of this Obligation or the performance of an obligation and the default persists after the Beneficiary has informed the Borrower of the default and the period within which it must be remedied, as required by law or in writing, the Beneficiary may declare the balance of the outstanding principal and the interest earned on this Obligation as being immediately due. Borrowers and any guarantor, endorser and guarantor waive all payment claims, payment statements, notices of intent to expedite the due date, notices of opportunity, protests and statements of protest to the extent permitted by law.
You can open or download this form in Adobe PDF, Open Document Format (.odt) or Microsoft Word (.docx) Important: If the purchase agreement (Section 2) and/or power of attorney (Section 5) information has been completed, keep reg 262 with the Application, even if the Odometer Disclosure Statement (Section 3) contains an error/modification. The next part of this form requires the attention of the purchaser of the vehicle. This part must not be completed until the buyer has consulted the mileage and verified this document. Once this task is complete, the buyer must sign their name in the “Buyer`s Signature” line. In addition, the buyer`s printed name must be clearly visible on the field designated as “Buyer`s Name”. California`s odometer disclosure statements include a declaration of perjury that is not required on other state auction, auto auction, or state surplus auction (GSA) forms. The next part of this form consists of several empty lines, each containing decisive information commonly used to identify a vehicle. First, indicate the make, body style and year of the vehicle in the appropriate areas. Once this form is completed, attach it to the purchase contract. This may not be necessary for all documents, however, such an action is widely considered a sign of good deals. Section 3: Odometer Disclosure Declaration – Completed at the time of sale by the seller, indicating the mileage, and signed by the buyer and seller.
Errors or changes invalidate the odometer disclosure statement. A new REG 262 for odometer disclosure is required with a factual submission form (REG 256) explaining why a separate odometer disclosure is attached. Do NOT return the correctly completed REG 262 forms to the client. This form requires both the seller and the buyer to sign this document and provide some basic information. Two separate sections have been set up for this purpose. First, find the words “seller`s signature.” Section 2: Purchase Agreement – Provided for convenience and may be used when a purchase agreement is required. The Seller`s signature is required in Article 4 if it is only used as a purchase contract. This section does not need to be completed if REGULATION 262 is only used for odometer disclosure. The purchase contract form (REG 135) is available online.
All states are required to provide an odometer disclosure section/section on compliant titles or forms. Odometer disclosure should include the following: When transferring title to a vehicle and changing ownership, owners must provide an accurate mileage. To do this, many state auto agencies provide a form called an odometer disclosure statement. In some cases, you can simply fill in the mileage on the certificate of title or application for registration. Find your status form below: In the first empty field of the declaration of this document, enter the full name of the seller of the vehicle REG 262 must be completed in ink and not in pencil as follows: Section 1: Vehicle/Vessel Identification – The Full Vehicle Identification Number (VIN) must be displayed, otherwise the application will be returned as incomplete. 8. INTEREST. Interest on this debt, which is proven by this obligation, may not exceed the maximum amount of non-usurious interest that may be contractually agreed, taken, reserved, debited or received under the law; any interest in excess of the maximum amount shall be credited to the amount of the debt or, if paid, repaid.
With each required or eligible acceleration or advance payment, this excess is automatically cancelled of the acceleration or advance payment or, if already paid, credited to the principal debtor or, if the amount of the principal debt has been paid, repaid. This provision prevails over the other provisions of this instrument (and all other instruments) concerning that debt. Finally, enter the status where the vehicle issued its last license plate in the blank box that says “Last License Plate Status”. Then indicate the last license plate attached to the vehicle in the “Last license plate” field. Next, the city, state, and zip code attached to the buyer`s address must be indicated in the empty fields labeled “City,” “State,” and “Zip Code.” 11. . . .
